Tanto la preservación del patrimonio arquitectónico como la accesibilidad física, sensorial e intelectual y comunicacional son reconocidos como derechos humanos. Cuando una persona o grupo encuentra condicionada su posibilidad de acceder, usar y disfrutar determinados espacios, sus derechos se encuentran vulnerados. Esto perjudica, principalmente, a personas con discapacidad, personas mayores, personas gestantes, niñas o niños, y tiene un impacto en la vida de todas y todos porque nadie está exento de necesitar condiciones de accesibilidad en algún momento de la vida. (...) Sin embargo, garantizarla en edificios protegidos no es tan sencillo como en una construcción nueva, y la legislación cumple un rol importante que es necesario analizar. En el caso de Argentina, y particularmente de la ciudad de Mar del Plata, se detectan grandes vacíos legales y una notable falta de articulación entre las temáticas, lo que impacta en la realidad material de sus construcciones protegidas. El objetivo de esta investigación es revisar y aportar a ese marco legal desde el enfoque de derechos para convertirlo en una herramienta acorde a los paradigmas actuales, con perspectiva de discapacidad y perspectiva de géneros. Empleando una metodología principalmente cualitativa, recopilando y estudiando de manera crítica una selección de normas que abordan el binomio accesibilidad y patrimonio a escala internacional, nacional y local, se busca contribuir a proteger los valores de los bienes y democratizar su acceso al mismo tiempo. La investigación etnográfica se ha desarrollado ampliamente en las últimas décadas, ha sido adoptada por numerosos campos del saber: sociología, psicología social, historia, y otras disciplinas sociales. Desde una perspectiva amplia y tradicional, la etnografía puede entenderse desde una triple acepción: como método, como texto y como enfoque (Guber, 2014). Nos interesa retomar esta última acepción dado que nos conduce a reflexionar en torno a su complejidad, más allá de la palabra dicha, recuperar los gestos, sensaciones, emociones, miradas, sentipensares que (...) dan sentido a los acontecimientos cotidianos. Las múltiples dimensiones de conocimiento que se ponen en juego en el trabajo de campo en tanto experiencia vivida (Quirós, 2011) como investigadores pueden ampliarse y debatirse a partir considerar el hecho de "dejarnos afectar" como instrumento metodológico. Acompañar y comprender los procesos socioeducativos en la escuela secundaria, su cotidianeidad, integra experiencias que constituyen, desde cada sujeto particular, acciones significativas de producción y reproducción social y apropiación cultural, así la vida cotidiana abarca gran cantidad de actividades mediante las cuales estudiantes, docentes, padres dan existencia a la escuela dentro del horizonte cultural que circunscribe cada comunidad. RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. De acuerdo con la tradición dominante de la teoría generativa, la creatividad lingüística es la capacidad de producir infinitas oraciones a partir de un conjunto finito de instrucciones sintácticas. Aunque esta idea de creatividad ha sido aceptada y festejada, sólo se trata de manejar una secuencia de categorías y escoger en cada paso un miembro de cada categoría. En efecto, la así llamada creatividad generativa no es más que una operación secuencial que ofrece opciones para cada punto de la secuencia, (...) y esto es comparable a la operación secuencial en la que completamos la bandeja con la comida disponible en el comedor. De hecho, la creatividad generativa no puede dar cuenta de los procesos verdaderamente creativos, por ejemplo de la invención de palabras nuevas o nombres originales. Por el contrario, el enfoque neurocognitivo asumido por la teoría de redes relacionales sí puede dar cuenta estos procesos genuinamente creativos. En este trabajo se mostrará cómo es el proceso neurocognitivo gracias al cual se crean y se entienden nombres cuya originalidad se basa en la ambigüedad deliberada. (shrink)

This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

This Open Access book offers a synthetic reflection on the authors’ fieldwork experiences in seven countries within the framework of ‘Authoritarianism in a Global Age’, a major comparative research project. It responds to the demand for increased attention to methodological rigor and transparency in qualitative research, and seeks to advance and practically support field research in authoritarian contexts. Without reducing the conundrums of authoritarian field research to a simple how-to guide, the book systematically reflects and reports on the authors’ combined (...) experiences in getting access to the field, assessing risk, navigating ‘red lines’, building relations with local collaborators and respondents, handling the psychological pressures on field researchers, and balancing transparency and prudence in publishing research. It offers unique insights into this particularly challenging area of field research, makes explicit how the authors handled methodological challenges and ethical dilemmas, and offers recommendations where appropriate. Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

This article explores the maternal experiences of a heterogeneous group of 26 mothers from Granada. The aim is to analyse the needs and demands that these women express with regard to childrearing, using a qualitative methodology. The authors conducted in-depth interviews and analysed the discourses of the mothers following the hermeneutical method. The variables used for sample selection and the themes that emerged during the interviews revealed that the discourses of the mothers revolve around three dimensions: indifference, demands and resignation (...) regarding support for childrearing. The lack of paternal involvement in childrearing appears as a transversal dimension. This article shows that the material conditions of existence marked the differences in the responses of the women regarding support for childrearing, while the sexual division of labour and gender inequalities unified their discourses. Stripping the Virgin Mary of the myths, stories, and dogmas surrounding her is a task that has particularly appealed to a branch of feminist theology which seeks to reclaim her as a figure of female empowerment. This article aims to explore the transformation of Mary’s body into an element of resistance in the work of some contemporary artists. By depicting her nude or semi-nude, artists disrupt the gender values commonly associated with the Virgin and open up alternative possibilities of affirmative (...) selfhood through her body. I contend that, in these works, the Virgin’s body functions as a ‘relational’ body that enters into dialogue with hitherto marginalized categories, such as the carnal, the sensual, the notion of fleshly materiality, or even the excluded sexualities of transgender people. This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions, but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends (...) on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as `thick resources with dynamic content'. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law's past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present. (shrink)

What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. -/- Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. This collection of original essays brings together leading legal historians and theorists to explore the oft-neglected but important relationship between these two disciplines. Legal historians have often been sceptical of theory. The methodology which informs their own work is often said to be an empirical one, of gathering information from the archives and presenting it in a narrative form. The narrative produced by history is often said to be provisional, insofar as further research in the archives might falsify present understandings (...) and demand revisions. On the other side, legal theorists are often dismissive of historical works. History itself seems to many theorists not to offer any jurisprudential insights of use for their projects: at best, history is a repository of data and examples, which may be drawn on by the theorist for her own purposes. The aim of this collection is to invite participants from both sides to ask what lessons legal history can bring to legal theory, and what legal theory can bring to history. What is the theorist to do with the empirical data generated by archival research? What theories should drive the historical enterprise, and what wider lessons can be learned from it? This book provides a collection of 11 cutting-edge essays by leading young scholars, challenging long-held assumptions and offering new research paradigms in Philosophy of Law, in five parts: 1) methodology/metatheory; 2) reasoning/evaluating; 3) values/the moral life; 4) institutions/the social life; and 5) the global/international dimension.

This paper offers an example of what may be called ‘an aesthetic history of legal and political thought’. Such a task engages in theorising historically the features of aesthetic traditions that enable and further normative inquiry, i.e. an exploration of the norms and values that might contribute to the good life and the common good. The three features offered in this paper as useful to identifying such aesthetic traditions are communality and interactivity, experimentalism, and exemplarity. The paper shows how each (...) of these features is present, in particular ways, in one specific aesthetic tradition, namely the declamatory tradition. Tracing the declamatory tradition back to Ancient Rome, and examining its influence in the English Renaissance, especially in Sir Thomas More’s response to Lucian’s declamatory thema, Tyrannicide, the paper argues that the particular ways in which declamatory practice combines the above three features enables those engaged in it to pursue normative inquiry. The paper argues that the integration of these three features is especially visible in one aspect of declamatory practice, namely the introduction and exchange of colores, i.e. changes in the narrative, introduced by declaimers and their audiences, which shed light on the possible motivation of a character, and thereby also invited shifts in affective allegiance and evaluative perspective. The paper argues that it is in large part through such introduction and exchange of colores that the declamatory tradition enables and furthers normative inquiry, and thus also offers a good reason for including the declamatory tradition in ‘an aesthetic history of legal and political thought’. The study of corporate social responsibility has been the object of much research in recent decades, although there is a need to continue investigating its benefits as a marketing tool. In the current work we adopt a multi-dimensional perspective of social responsibility, and we carry out market research to determine the perceptions of users of mobile telephone services about economic, legal, ethical and social aspects of their operating companies. With these data we determine the structure and components of the concept (...) of social responsibility. Subsequently, this is related with the overall evaluation of the service and loyalty by means of a model of structural equations, in order to determine the influence of corporate social responsibility on these concepts, and hence its benefits as a commercial tool. This paper considers the similarities between Adam Smith's device of the impartial spectator and the use of perspectival devices in common law reasoning. The paper adopts a reading of Smith's device as one involving the exercise of imaginative sympathy by an ordinarily virtuous, and culturally and historically situated, spectator who does not have a stake in the outcome of the scene being evaluated. The point here is to show that the impartial spectator is 1) a device of common, ordinary virtue (...) – both in the sense of being located in a culture at a specific point in time, and in the sense of possessing only moderate, achievable virtues ; and 2) a device that enables a focus on a situation, which requires imaginative work, emotional engagement and careful, particularised description. Having so modelled Smith's device, the paper shows the similarities between it and the use of perspectival devices in common law reasoning, specifically here via the ‘right-thinking member of society' test in defamation law. This paper discusses a much-neglected aspect of Neil MacCormick's theory of legal reasoning, namely what he calls ‘consequential reasoning’. For MacCormick, consequential reasoning is both an omnipresent feature of legal reasoning in England and Scotland, as well as being a valuable one. MacCormick articulates the value of consequential reasoning by seeing it as contributing to the forward-looking requirement of formal justice, ie, of deciding the instant case on grounds that one is willing to adopt when deciding future similar cases. This (...) paper situates consequential reasoning in the overall picture of legal reasoning MacCormick develops in Legal Reasoning and Legal Theory, going on to show the evolution of his view on consequential reasoning in later work, which culminates in Rhetoric and the Rule of Law. It is argued that MacCormick's later view of consequential reasoning, ie, of a process of testing possible rulings by evaluating the acceptability or unacceptability.. (shrink)

This paper argues that the exercise of the imagination requires us 1) to attempt to describe features of a certain practice that appear, at first blush, natural and obvious; 2) to understand that that which appears natural and obvious could be otherwise; and 3) to be open to the introduction of changes to that which appears natural and obvious. Imagination, in this sense, is quite different to creativity. The latter works on the basis of the introduction of variations to settled (...) phenomena. This exercise of creativity is important, but ultimately, it contributes principally to the stability and identity of a community and reinforces its most firmly established features. Imagination, on the other hand, is more difficult, for it strikes at the very heart of that which is settled. Changes to that which is settled may not only be resisted, but may also be violently opposed. And yet, it is precisely the very ability and willingness to be open to such changes that may be of the most ethical and political significance. These differences between creativity and imagination are illustrated in the context of the practice of philosophy. (shrink)

The concept of corporate social responsibility is becoming integral to effective corporate brand management. This study adopts a multidimensional and cross-country perspective of the concept and analyses consumer perceptions of behaviour of four leading consumer products manufacturers. Data was collected from consumers in two countries – Spain and the UK. The study analyses consumers’ degree of interest in corporate responsibility and its impact on their perception about the company. The findings here suggest a weak impact of company-specific communication on consumers’ (...) perception. The implications of this study are relevant to companies for strengthening their social responsibility associations with the consumers. (shrink)

This paper argues that concepts of legality in legal theory can be profitably understood as being underwritten by modes of spatio-temporal objectification. In the first part of the paper, a scheme of such modes is provided, and a map of jurisprudential inquiries is thereby offered. In the second part of the paper, two concepts of legality – underwritten by two different modes of spatio-temporal objectification – are analysed. The analysis shows how both concepts of legality lead to different sets of (...) prescriptive resources as to the evaluation and design of legal systems. Finally, it is argued that the response of legal theory to practical challenges within the public sphere cannot afford to be based on any one concept of legality. Rather, we need to be pluralists about concepts of legality, recognising the limitations of any one such concept – represented, in this paper, by way of spatio-temporal objectification that underwrites those concepts. A crisis in legal theory can- not be claimed on the basis of any alleged lack of correspondence between any one concept of legality and reality. On the contrary, a crisis will ensue to the extent that legal theory becomes dominated by theoretical imperial- ism, namely, by the belief that any one concept of legality is capable of capturing the world as it is, and, therefore, also capable of standing as a foundation for a prescriptive agenda. The vice of theoretical imperialism in- duces anxiety over the identity of a discipline, and leads to a quelling of the very theoretical diversity that is required for an ethical response to the spe- cific complexity of the public sphere.Resumen:En este artículo se sostiene que los conceptos de legalidad, dentro de la teoría del derecho, pueden entenderse con mayor provecho si se piensa que están determinados por modos de objetivación espacio-temporal. En la primera parte se presenta un esquema de tales modos y, de esa manera, se ofrece un mapa de las investigaciones iusfilosóficas. En la segunda parte, se analizan dos conceptos de legalidad —determinados por dos modos diferentes de objetivación espacio-temporal—. El análisis muestra cómo ambos conceptos de legalidad conducen a diferentes conjuntos de fuentes prescriptivas para la evaluación y el diseño de los sistemas jurídicos. Finalmente, se sostiene que la respuesta de la teoría del derecho a los problemas prácticos del ámbito público no puede basarse en un solo concepto de legalidad. Por el contrario, es necesario ser pluralistas sobre los conceptos de legalidad y reconocer las limitaciones de cada uno de ellos —representados, en este ensayo, por la objetivación espacio-temporal que los suscribe—. No se puede asegurar que la teoría del derecho esté en crisis sobre la base de una presunta falta de correspondencia entre algún concepto de legalidad y la realidad. Por el contrario, aquella se generará en la medida en que la teoría del derecho llegue a estar dominada por un imperialismo teórico, a saber, por la creencia de que cualquier concepto de legalidad es capaz de capturar el mundo tal como es, y, por lo tanto, que es capaz de erigirse como fundamento para una agenda prescriptiva. El vicio de un imperialismo teórico induce una inquietud sobre la identidad de una disciplina, y conduce a sofocar la diversidad teórica que se requiere para dar una respuesta ética a la complejidad concreta del ámbito público. This paper considers whether, and if so how, the modelling of joint action in social philosophy – principally in the work of Margaret Gilbert and Michael Bratman – might assist in understanding and applying the concept of concerted practices in European competition law. More specifically, the paper focuses on a well-known difficulty in the application of that concept, namely, distinguishing between concerted practice and rational or intelligent adaptation in oligopolistic markets. The paper argues that although Bratman's model of joint action (...) is more psychologically plausible and phenomenologically resonant, its less demanding character also makes it less useful than Gilbert's in our understanding of the legal concept of concerted practice and in dealing with the above difficulty. The paper proceeds in two parts: first, a discussion of the concept of concerted practices in European competition law; and second, a discussion of Gilbert and' Bratman's models of joint action, including a comparative assessment of their ability to provide an evidentiary target and an evidentiary platform for conceited practices. This paper offers a brief reply to William Morgan’s critique of my review of Andrei Marmor’s Social Conventions . Morgan’s principal critique is that I am wrong to think that the constitutive rules of games do not determine their aims and values. In particular, with regards to chess, Morgan argues that the rules of chess determine that the aim of playing chess is to win the game. I defend my position that one can play the game of chess without the (...) aim of winning - e.g. one can aim to play beautifully, and not, as Morgan suggests, only to win beautifully. More broadly, I argue for an account of games that is sensitive to the gap between playing and the game’s constitutive rules. Ultimately, the argument points to the descriptive priority for the social sciences of the concept of ‘play’ over the concept of games understood as ‘rule-governed domains’. (shrink)
